Authorizing the execution of a Right of Entry and a Conveyance of Rights in Land by the City of Madison in favor of the City of Fitchburg in connection with Transportation Project Plat No. 19-3488-4.10, Relocation Order North Fish Hatchery Road (CTH D), (CTH PD (McKee Road) - Madison Beltline) reconstruction project. (14th AD)
Body
WHEREAS, the City of Fitchburg (“Fitchburg”) plans to reconstruct North Fish Hatchery Road from County Highway PD to the Madison Beltline pursuant to Transportation Project Plat 19-3488-4.10 (the “TPP”); and
WHEREAS, Fitchburg requests the release of certain utility rights from the City of Madison (“City”) for water main facilities located on portions of lands identified as Parcel 51 and Parcel 52 in the TPP; and
WHEREAS, the City and Fitchburg agree that the release of utility rights shall be accomplished by recording a Right of Entry and a Conveyance of Rights in Land (collectively, the “Utility Releases”), at no cost to either party; and
WHEREAS, the City’s Water Utility, Engineering Division, and the Office of Real Estate Services have reviewed the TPP and the Utility Releases and approve of Fitchburg’s request.
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of Madison authorizes the release of rights for water main facilities by the execution of a Right of Entry and Conveyance of Rights in Land from the City of Madison in favor of the City of Fitchburg, at no cost to either party, for utility interests identified in Transportation Project Plat No. 19-3488-4.10, depicted on Exhibit A.
BE IT STILL FURTHER RESOLVED, that the Mayor and Clerk are authorized to sign any and all documents and legal instruments required to complete the request contemplated in this resolution.
