Body
WHEREAS, the City has plans for a future photovoltaic system installation of over 20kW at the Madison Municipal Building at 215 Martin Luther King Jr Blvd which is part of Madison Gas and Electric Company’s (“MGE”) Spot Network; and

WHEREAS, the Spot Network is a system that is incompatible with back feed of electricity from any source and automatically separates from any source that back feeds electricity; and

WHEREAS, the Spot Network will shut off all electrical service to the Madison Municipal Building in the event of the photovoltaic generating equipment back feeding electricity; and

WHEREAS, the City is installing equipment as part of its photovoltaic system designed to prevent it from back feeding electricity onto the Spot Network; and

WHEREAS, under Wis. Admin Code ch PSC 119.20(13), the owner of a distributed generation system in a spot network must provide relaying and control equipment that is acceptable to the public utility; and

WHEREAS, MGE has indicated that it will only accept the City’s chosen relay and control equipment if the City agrees to an addendum to the PSC approved Interconnection agreement; and

WHEREAS, as part of the “Addendum to Distributed Generation Interconnection Agreement Form 6030”, MGE is requiring the City to further indemnify MGE related to a shut off due to back feed electricity from the City’s photovoltaic generating equipment, except in the case of MGE’s own negligence or intentional wrongdoing; and

WHEREAS, APM 1-1 requires Common Council approval before the City indemnifies another party in a contract;
