SUBSTITUTE - Creating new Section 8.19(1), renumbering Sections 8.19(2) through (4) to Sections 8.19(3) through (5), creating Section 8.19(2)(a)3. and Sections 8.19(1)(b)5., 6., and 7 of the Madison General Ordinances to prohibit dogs in any City space.

DRAFTER'S ANALYSIS: This ordinance creates a definition of City space to mean any building or portion of a building that is occupied by the City. The ordinance prohibits dogs in all City spaces. The ordinance currently has an exception for law enforcement and service dogs. This ordinance creates an additional exception for dogs when authorized under a rental or use space agreement. It creates a further exception for when a permit has been issued permitting the dog to be present. The ordinance also creates an exception for dogs to be in City spaces when the dog is present as part of programming that is intended for the general public and has been approved by the Department or Division Head.

The Common Council of the City of Madison do hereby ordain as follows:
1. New Subsection (1) entitled “Definitions” of Section 8.19 entitled “Animals Prohibited in Certain Areas” of the Madison General Ordinances is created to read as follows:
“(1) Definition. “City space” means any building or portion of a building that is occupied by the City.”
2. Subsections (2) through (4) of Section 8.19 entitled “Animals Prohibited in Certain Areas” of the Madison General Ordinances are hereby renumbered to Subsections (3) through (5), respectively.
3. The title of Subsection (2) entitled “Dogs Prohibited in Parks and on School Grounds” of Section 8.19 entitled “Animals Prohibited in Certain Areas” of the Madison General Ordinances is amended to read as follows:
“(2) Dogs Prohibited in Parks, and on School Grounds, and in City Spaces.”
4. Subdivision (a) entitled “Prohibition” of Subsection (2) entitled “Dogs Prohibited in Parks, on School Grounds and in City Spaces” of Section 8.19 entitled “Animals Prohibited in Certain Areas” of the Madison General Ordinances is amended to read as follows:
“(a) Prohibition. Except as provided for under Subdivision (b), no owner, keeper or handler of a dog shall allow, cause or permit such dog to enter or remain in either :”
5. Paragraph 3. entitled “Dogs in City Space” of Subdivision (a) entitled “Prohibition” of Subsection (2) entitled “Dogs Prohibited in Parks and on School Grounds” of Section 8.19 entitled “Animals Prohibited in Certain Areas” of the Madison General Ordinances is created to read as follows:
“3. Any City space.”
6. Paragraph 5. entitled “Rental Space, Paragraph 6. entitled “Permit” and Paragraph 7. entitled “Programming” of Subdivision (b) entitled “Exceptions” of Subsection (2) entitled “Dogs Prohibited in Parks, on School Grounds and in City Spaces” of Section 8.19 entitled “Animals Prohibited in Certain Areas” of the Madison General Ordinances are created to read as follows:
“5. Rental Space. Dogs are permitted when there is an agreement for rental or use of any City space and such permission is specified in the rental or use agreement.
6. Permit. Dogs are permitted in any City space when authorized under a permit.
7. Programming. Dogs are permitted in any City space when the dogs are part of programing that is intended for the general public and has been approved by the Department or Division Head.”
