Fiscal Note

The proposed resolution authorizes the execution of a Declaration of Easement for Public Utility Purposes for the benefit of all public utility companies registered to do business in the City of Madison for the placement of underground utility facilities across a portion of Olbrich Park. No City appropriation is required.

Title

Authorizing the execution of a Declaration of Easement for Public Utility Purposes across a portion of Olbrich Park for purposes of serving the Garver Feed Mill redevelopment site.

Body

WHEREAS, Madison Gas and Electric Company (“MG&E”) has requested an underground electric easement across a portion of Olbrich Park to bring service to the Garver Feed Mill redevelopment site; and

 

WHEREAS, staff of the City of Madison Parks Division and Office of Real Estate Services have reviewed and approve of such easement request, but also recommend that the easement be designated for use by other utilities that may have the future need to locate facilities in the easement area to serve said property.

                      

NOW, THEREFORE, BE IT RESOLVED that the Mayor and the City Clerk are hereby authorized to execute a Declaration of Easement for Public Utility Purposes for the benefit of all public utility companies registered to do business in the City of Madison for the placement of underground utility facilities across a portion of Olbrich Park to serve the Garver Feed Mill redevelopment site. The easement area is legally described as follows and is depicted on attached Exhibit A:

 

Two strips of land, ten (10) feet in width, located in Lots 1, 2, 3, and Outlot 2, Certified Survey Map No. 14664, Document No. 5374623, in Volume 102, Pages 13-24 of Certified Survey Maps as recorded at the Dane County Register of Deeds Office, lying in part of the NE ¼ of the SW ¼ and the NW ¼ and the SW ¼ of the SE ¼ of Section 5, T7N, R10E, City of Madison, Dane County, Wisconsin, the centerlines of said strips being more particularly described as follows:

 

The right-of-way shall be located 5 feet on the right side and 5 feet on the left side of the centerline of the facilities as constructed.  The facilities will be located approximately as set forth in the drawing attached hereto as Exhibit A.
