Authorizing the City to Accept the Dedication of Property at 2005 East Springs Drive from East Town Plaza LLC for Stormwater Improvements. (17th AD)
Body
WHEREAS, East Town Plaza LLC (“Owner”) owns the property located at 2005 East Springs Drive (the “Property”) in Madison, an undeveloped parcel immediately adjacent to a large City-owned parcel located at 1801 Zier Road used for stormwater drainage purposes; and,
WHEREAS, the Property is used to drain portions of the East Town Mall property to the north of East Springs Drive and is connected to the properties to the north by two private stormwater laterals (the “Pipes”) running under East Springs Drive; and,
WHEREAS, the City has proposed reconstructing the storm water detention area located adjacent to the Property and has requested that the Owner dedicate the Property for use in the City’s storm water detention area reconstruction project; and,
WHEREAS, Owner has agreed to dedicate the Property and the Pipes to the City pursuant to a quit claim deed, subject to certain conditions; and,
WHEREAS, the City is agreeable to Owner’s conditions and accepting ownership of the Property and the Pipes subject to those conditions.
NOW THEREFORE BE IT RESOLVED that the Mayor and the City Clerk are hereby authorized to enter into a Dedication Agreement Relating to the East Springs Drive Drainage Way and Quit Claim Deed with East Town Plaza LLC, and accept dedication of the Property and the Pipes, in a form consistent with the attachments hereto that has been approved by the City Attorney, the Risk Manager and the City Engineer.
