Temporary Land Use Permit - Request from the Water Utility to install a monitoring well in Edward Klief Park

 

Body

The City of Madison Parks Division has received a request from the Madison Water Utility or their contractor (“Contractor”) to temporarily utilize a portion of City-owned Klief Park, located at 30 S. Charter Street, for the installation of a temporary monitoring well.

 

The Water Utility will be allowed the temporary use of the area identified in Klief Park under the following terms and conditions:

 

 

The Water Utility will contract for the installation and removal of the temporary monitoring well at a location to be approved by the Parks Superintendent.

 

If the ground is saturated or wet conditions exist, the Parks Division has the right to dictate the date when the monitoring well installation will occur to minimize disturbance to the ground.  Alternatively the Contractor performing the work will either place sod protection on the ground in the area of the work or shall be responsible for restoration of the turf and disturbed areas in the park in kind.

 

The Contractor will use a defined route for accessing the park as approved by the Parks Superintendent. 

 

The Contractor shall be required to place the temporary well within the landscape bed in a location that will not negatively impact the existing trees, as determined by the City Forester. The location may require the landscape bed to be expanded so the well access is not located in a grassed area.

 

Any tree trimming required to accommodate the drilling equipment shall be done by City of Madison Parks staff.  The Water Utility or their Contractor shall contact Parks staff a minimum of 2 weeks prior to performing the work in order to schedule and complete any trimming, as required.

 

Due to the heavy park usage, if the well access becomes problematic or is damaged, the access may be required to be replaced with a flush mount or low profile access point or may be required to be removed, if deemed necessary by the Parks Superintendent.

 

Applicant shall comply with all applicable laws, ordinances and regulations related to environmental pollution or contamination, or to occupational health and safety.

 

The Contractor shall be prequalified by the City of Madison to perform this work.

 

The Water Utility or their designee shall be responsible for notifying the Alder and providing a letter to nearby properties and other interested parties prior to work being performed at the park. A copy of the notification shall be provided to the Parks Superintendent or his designee.

 

The Contractor shall be required to include temporary construction fencing around any equipment in the park, which shall be removed during times where there is no work being performed.

 

The Water Utility shall contact Chad Hughes at (608)267-8805 a minimum of 48 hours (2 working days) in advance of performing any work related to this use.  Work shall only begin upon written or verbal approval by the Madison Parks Division.

 

The City of Madison reserves the right to use and occupy the Property in a manner consistent with the rights conveyed herein, provided that such use and occupancy shall not interfere with or disturb the activities within the Park.
