Authorizing the Mayor and City Clerk to execute an Intergovernmental Agreement Relating to the Transfer of Sanitary Sewer Improvements and Service for the Blooming Grove Sewer District #10. 

Body

WHEREAS, in approximately 1957, Blooming Grove constructed sanitary sewer mains and other improvements within the Clyde A. Gallagher Subdivision, establishing the Blooming Grove Sewer District #10 (herein referred to as BGSD#10); and,

 

WHEREAS, BGSD#10 currently serves many Blooming Grove parcels located on Zinc Avenue, Bruns Avenue, and Alvarez Avenue, before discharging to a City of Madison owned sewer; and,

 

WHEREAS, Blooming Grove and Madison have expressed mutual interest about Madison taking BGSD#10 from Blooming Grove, including transferring all assets and liabilities to Madison, at which point Madison would assume ownership of the sewers and / or responsibility for service to the respective customers and continue to provide sanitary sewer service to the BGSD#10 properties presently being served by  Blooming Grove; and,

 

WHEREAS, the Madison Sewer Utility has found that the Blooming Grove sewers are in adequate condition and that assumption of these assets and liabilities and continuing service to the Blooming Grove properties connected to the Blooming Grove Sewer is in the best interests of the City.

 

 

NOW, THEREFORE, BE IT RESOLVED that Common Council approves the terms and conditions of the Intergovernmental Agreement Relating to the Transfer of Sanitary Sewer Improvements and Service for the BGSD#10, attached hereto and incorporated by reference; and,

 

 

BE IT FURTHER RESOLVED, that the Mayor and the City Clerk are authorized to execute the Intergovernmental Agreement Relating to the Transfer of Sanitary Sewer Improvements and Service for the BGSD#10, and any other document necessary to effectuate the transfer of services to the City of Madison as provided for in the Agreement, on a form and in a manner that has been approved by the City Attorney and the Risk Manager; and,

 

BE IT FURTHER RESOLVED, that the Common Council finds that upon transfer of BGSD#10, it is in the City’s best interests to provide sanitary sewer service to the town properties in accordance with the Agreement and pursuant to Madison General Ordinances Sec. 35.02(4)(b).
