PREAMBLE

 

 

 

The City has a project to replace the pavement, curb and gutter, sanitary sewer main and laterals, and the water main and reconnect all water services to the new main.  The Project is planned to take place from late March thru the middle of August in 2016.

 

The work of this project cannot be constructed between the hours of 7:00 AM and 7:00 PM because:

 

1.                     Sawcutting of concrete pavements after the pouring of the pavement must be done several hours after the installation as the new concrete must be hard enough to hold the machinery.  The sawcutting must also be done soon enough after paving so that the sawcutting occurs before the pavement cracks.

2.                     During the time of the project there are several events taking place, namely Concerts on the Square, in which the Contractor is required by the provisions of the contract to stop work early on those days so that the event is not impacted by the work, and this would prevent the sawcutting from being completed in the timeframe necessary to prevent cracking of the new pavement.

 

3.                     Water shut-offs will be required in order to connect the properties within the limits of the project to the new water mains being constructed.  Several of these properties are businesses that are very sensitive to water shut-offs during normal business hours, so much so that the business would not be able to operate normally while the water is turned off. 

 

The proposed activities beyond the hours of 7:00 AM to 7:00 PM are as follows:

 

1.  The Sawing of Concrete Pavement.  The timing of this activity is dependent on the rate at which the concrete cures. 

 

2.  Water service reconnections.  Most of the excavation work necessary for the water service reconnections at the sensitive properties could be done within the normal hours of 7:00 AM to 7:00 PM, but pipe connections, backfilling, and securing the trench with steel plates would be required beyond the hours of 7:00 AM to 7:00 PM in order to coordinate timing of the water shut-offs with the businesses.

 

 

The estimated Dates are as follows:

 

                     1.  Water services between Wisconsin Ave. and E. Washington Ave. - mid/late May

 

                     2.  Concrete Sawcutting between W. Washington Ave. and Wisconsin Ave. - mid/late June

 

                     3.  Concrete Sawcutting between Wisconsin Ave. and E. Washington Ave. - mid/late July

 

                     4.  In total, work beyond the hours of 7:00 AM to 7:00 PM will be limited to a total of 5 nights.

 

5.  Work beyond the hours of 7:00 AM to 7:00 PM will be limited to no later than 10:00 PM on each of these 5 nights.

                     

These date ranges are approximate, and will be more clearly defined as the work areas are identified or as weather and unforeseen circumstances dictate.

 

Construction activities generally exceed the noise limits imposed by the Madison General Ordinances and temporary construction activity between the hours of 7:00 AM to 7:00 PM is allowed to exceed the noise limits imposed by the Madison General Ordinances section 24.08 (3) provided the Common Council adopts a resolution allowing the construction. 

 

NOW THEREFORE BE IT RESOLVED, that construction work, with associated noise impacts, between the hours of 7:00 PM and 7:00 AM on the 10 Blocks East & West Mifflin Street, North Carroll Street and North Pinckney Street between W. Washington Ave. and E. Washington Ave. (Capitol Square, north half) are hereby approved in accordance with section 24.08(3) of the Madison General Ordinances, and

 

BE IT FURTHER RESOLVED, that the construction activities outside of the hours of 7:00 AM to 7:00 PM are limited to those activities identified in this resolution and are limited to the hours specified, and

 

BE IT FURTHER RESOLVED, that the approval of that construction work, as provided in this resolution shall expire on December 31, 2016.
