Fiscal Note

The proposed resolution adds land to an existing 5-year lease (executed July 9, 2015) between the City and Community GroundWorks, Inc. for community garden sites at various locations. The existing lease requires Community GroundWorks, Inc. to pay rent of $1 per year for use of City-owned property. This resolution adds land in Rennebohm Park to the existing lease at no additional cost.

SECOND SUBSTITUTE Supporting the execution of a First Amendment adding a community garden at Rennebohm Park to the Lease executed between the City and Community GroundWorks, Inc. for various community garden sites on City-owned land.

Body

WHEREAS, on May 19, 2015, the City of Madison Common Council passed Resolution No. RES-15-00452 authorizing the execution of a master lease, and any necessary amendments thereto, for various community garden areas on City-owned land; and

 

WHEREAS, in accordance with the aforementioned Resolution, the City and Community GroundWorks, Inc. (“Lessee”) executed the Lease dated July 9, 2015 and recorded on July 15, 2015 with the Dane County Register of Deeds as Document No. 5168439 (“Lease”); and

 

WHEREAS, after a neighborhood meeting and discussions in the community, there is consensus that space for an additional garden area should be provided within a portion of Rennebohm Park; and

 

WHEREAS, due to the nature of the community discussion regarding the addition of a garden area to Rennebohm Park, it is desired that a supporting resolution be presented to Council; and

 

WHEREAS, the City and Lessee desire to amend the Lease to include the additional garden area within Rennebohm Park.

 

NOW, THEREFORE, BE IT RESOLVED that the Mayor and City Clerk support the execution of a First Amendment to Lease with Community GroundWorks, Inc. (the “Lessee”) to provide space within Rennebohm Park for a community garden area, as described in the attached Exhibit A and depicted in the attached Exhibit C, subject to the terms and conditions in the attached Exhibit B. All other provisions of the Lease shall remain unchanged and in full force and effect.

 

BE IT FINALLY RESOLVED that Community Groundworks will report back on the results of the first growing season to the Board of Park Commissioners.
