Title
Authorizing the execution of an Underground Electric Line Easement to Madison Gas and Electric Company, across a portion of the City Water Utility Operations Center property, located at 110 South Paterson Street.
Body
WHEREAS, the City Water Utility is remodeling its Operations Center facility (“Operations Center”) located at 110 South Paterson Street (“Property”); and
WHEREAS, Madison Gas and Electric Company (“MG&E”) will be installing new underground electric service to serve the Operations Center, and therefore have requested an underground electric line easement, across a portion of the City Water Utility Operations Center property; and
WHEREAS, the City Water Utility will be constructing a security fence along the boundary of the Property and said fence will be located within the proposed easement area; and
WHEREAS, MG&E hereby consents to the City Water Utility’s construction of a security fence with concrete bases and footings, and the installation of a pad-mounted standby generator, within the proposed easement area; and
WHEREAS, MG&E further acknowledges that these improvements will not constitute a violation of the proposed easement agreement provided the City Water Utility’s use of the proposed easement area does not prevent MG&E from exercising any of its easement rights.
WHEREAS, City Water Utility and Office of Real Estate Services staff have reviewed and approve of the granting of said new underground electric easement.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and the City Clerk are hereby authorized to execute an Underground Electric Line Easement to MG&E, across a portion of the City Water Utility Operations Center property, located at 110 South Paterson Street, legally described as follows:
A strip of land, fifteen (15) feet in width, located in Lot 1, Certified Survey Map No. 13986, Document No. 5158917, in Volume 93, Pages 202-204 of Certified Survey Maps as recorded at the Dane County Register of Deeds Office, lying in part of the NW¼ of the SE¼ of Section 13, T7N-R9E, City of Madison, Dane County, Wisconsin, said strip being more particularly described as follows:
The southwest fifteen feet of said Lot 1, Certified Survey Map No. 13986, Document No. 5158917, as shown on the Easement Drawing attached hereto as Exhibit “A.”
