Title

Resolution Amending and Supplementing Resolution Accepting Grant from the Casey Family Programs

Body

WHEREAS, on May 5, 2015, the Council approved Resolution RES-15-00411, Legistar File No. 38160, accepting a grant from the Casey Family Programs to prepare a blueprint for reducing opportunity gaps in Madison; and

WHEREAS, the grant conditions contain a requirement that the City indemnify the Casey Family Programs under the grant; and

WHEREAS, pursuant to APM 1-1, the inclusion of an indemnification provision requires the express approval of the Common Council; and

WHEREAS, that while the indemnification clause increases the City’s exposure to risk, the City has coverage for indemnification clauses under its current insurance policy, subject to the policy’s terms and conditions; and

WHEREAS, the prior resolution provided that the City was to fund L. Torry Winn to carry out the grant conditions, and Mr. Winn’s name is actually Lawrence Tavares Winn.

NOW, THEREFORE, BE IT RESOLVED, that the prior resolution referenced above is amended and supplemented by this resolution; and

BE IT FURTHER RESOLVED, that the Council authorizes the City to accept the grant conditions that include an indemnification clause in favor of the Casey Family Programs; and

BE FINALLY RESOLVED, that the Mayor and City Clerk are authorized to enter into a purchase of services agreement with Lawrence Tavares Winn, in the amount of the grant award of $78,000, to prepare the blueprint contemplated by the grant.
