Body
WHEREAS, the Common Council of the City of Madison established the South Point Streetlight Assessment District - 2011 (hereinafter "the District") on May 9, 2011 (RES-11-00404, Legistar File No. 21960) in accordance with Section 66.0701 of the Wisconsin State Statutes and Section 4.09 of the Madison General Ordinances; and
 
WHEREAS, the Common Council approved the plans, specifications and schedule of assessments for the District on June 10, 2011 (RES-11-00495, Legistar File No. 22392), which identified $82,650 of assessable costs for street lighting on South Point Road from 250 feet north of Harvest Moon Lane to Mineral Point Road; and
 
WHEREAS, it is necessary to expand the District south to Harvest Moon Lane, which expansion will include two additional parcels; and
 
WHEREAS, the new estimate of total assessable costs to the City for street lighting in the expanded District will now be $84,014.26;
 
NOW, THEREFORE, BE IT RESOLVED:
 
1.  That pursuant to Section 4.09(9) of the Madison General Ordinances, the Common Council hereby determines that the District is hereby reopened to include two additional parcels, and the final schedule of assessments is amended to properly account for the costs of street lighting associated with these parcels.  
 
2.  The additional sums so charged to the two additional properties be and are hereby assessed and levied upon said properties payable by the owners of the lots or parcels of land benefited as determined by the Board of Public Works; and in accordance with its recommendations, the additional and total amount so charged to each of the lots or parcels of land so benefited being as follows, to wit:  see attached.
 
3.  That the City at large is justly chargeable with and shall pay the sum of $ -0- of the entire cost of said improvement, and that the sum assigned to each separate parcel, as indicated on the attached schedule of assessment, is hereby specially assessed upon each such parcel.
 
4.  That the Common Council determines such special assessments to be reasonable.
 
5.  That the work or improvement shall be carried out in accordance with the Report of the Board of Public Works and the Report of the City Traffic Engineer as finally approved.
 
6.  That such work or improvement represents an exercise of the police power of the City of Madison.
 
7.  That after the streetlights are installed, the City Traffic Engineer will prepare a revised assessment and bill the revised amount to each property owner. The property owner may elect to pay the assessment prior to October 31st of the year in which it was billed, or pay the assessment when the property tax bill becomes due;
 
8.  That the due date by which all such special assessments shall be paid in full is October 31st of the year in which it is billed; or,
 
9.  That special assessments shall be collected in eight (8) equal installments, with interest thereon at three and one-half percent (3.5%) per annum, except those special assessments paid in full on or before October 31st of that year.
 
INSTALLMENT ASSESSMENT NOTICE
 
Notice is hereby given that work is being scheduled for the project listed above and that the amount of the special assessment therefore has been determined as to each parcel of real estate affected thereby and a statement of the same is on file with the City Clerk; it is proposed to collect the same in eight (8) installments, as provided for by Section 66.0715 of the Wisconsin Statutes, with interest thereon at 3.5% percent per annum; that all assessments will be collected in installments as above provided except such assessments on property where the owner of the same has paid the assessment to the City Treasurer on or before the next succeeding October 31st.
 
 
NOTICE OF APPEAL RIGHTS
 
Pursuant to Section 4.09(14), Madison General Ordinances, as authorized by Section 66.0701(2), Wisconsin Statutes, any person against whose land a special assessment has been levied by this resolution has the right to appeal therefrom in the manner prescribed in Section 66.0703(12), Wisconsin Statutes, within forty (40) days of the day of the final determination of the Common Council, said date being the date of adoption of this resolution.
