Body
WHEREAS, the property owner, the Board of Regents of the University of Wisconsin System has requested to have a landscaping island installed within the N. Park Street and W. Johnson Street rights of way, and,
 
WHEREAS, the Board of Regents of the University of Wisconsin System was required to enter into a maintenance agreement with the City for said improvements of way to insure the public's long term use and function of the landscaping within the rights of way as requested.
 
NOW, THEREFORE, BE IT RESOLVED:
 
1.      That the Mayor and City Clerk are hereby authorized and directed to execute an agreement between The City of Madison and the Board of Regents of the University of Wisconsin System  for the maintenance of portions of the public rights of way on N. Park Street and W. Johnson Street.
 
2.      The Common Council is approved to accept ownership of the improvements in the Maintenance Area if a maintenance agreement is executed and recorded as a condition of the proposed improvements.
