Authorizing the Mayor and the City Clerk to execute an Intergovernmental Agreement between the City of Madison and the City of Fitchburg relating to providing Water Service within the City of Fitchburg in the Danville Drive area (Citywide).
 
Body
WHEREAS, the City of Fitchburg has requested that the Madison Water Utility provide a wholesale metered water connection to the Fitchburg water system in the Danville Drive area of Fitchburg.  This proposed service area has been identified and is incorporated herein as Attachment 1 to this resolution.  Fitchburg has historically served this small area through a water booster station due to the elevation of the service area. This booster station has reached the end of its useful life. Fitchburg desires to convert this section of their system to be supplied from the Madison system and eliminate the need for the water booster station; and,
 
WHEREAS, Section 13.16 of the Madison General Ordinances allows the City to provide water service to properties outside of the City's corporate limits identified by an intergovernmental agreement, subject to certain conditions; and,
 
WHEREAS,  the City of Madison and the City of Fitchburg have negotiated an agreement for the Madison Water Utility to provide wholesale water service to the Danville Drive Area, with the City of Fitchburg agreeing to pay all costs for connection. As a condition of this agreement, the City of Fitchburg will maintain the metered connection and pay the Madison Water Utility for the water used based on current wholesale rates established and approved by the Public Service Commission; and,
 
WHEREAS, the Madison Water Utility has the capacity to supply water to the City of Fitchburg, the connection will not be contrary to the policies set forth in Section 13.16, Madison General Ordinances, and the Water Utility General Manager has approved this extension of service.
 
NOW THEREFORE BE IT RESOLVED that the Mayor and the City Clerk are authorized to execute an Intergovernmental Service Agreement between the City of Madison and the City of Fitchburg for the wholesale water supply by the Madison Water Utility to the Danville Drive water service area to allow service to this area pursuant to Section 13.16, Madison General Ordinances.
 
BE IT FURTHER RESOLVED that the method of connection to the City of Madison water supply shall comply with any additional conditions required by the Board of Public Works, the Water Utility Board or the City Engineer, Madison Water Utility standards, and City of Madison permitting requirements.
