This resolution amends the 2013 Library Capital Budget to increase budget authority in the Central Library project to allow for the Central Library Contractor, Architect/Engineer, and Commissioning Agent to invoice costs related to a pipe break at the Central Library construction project.  The total construction costs and professional fees related to the pipe break are estimated at $200,000 (Contractor $190,000, Architect/Engineer $7,000, Commissioning Agent $3,000).  This amount will be reimbursed by the City's builder's risk insurance proceeds minus the deductible of $25,000.  It is the City's intention that the Contractor will cover the deducitible cost, so the budget is being amended by $175,000.  No additional General Obligation Debt is required.

PREAMBLE, In February 2013 a pipe froze and broke at the Madison Central Public Library construction project and damaged installed construction work.  The Contractor must replace/repair any installed construction material damaged by the pipe break at an estimated construction cost of $190,000.  The Architect/Engineer has submitted extra design and construction administration costs related to the pipe break at an estimated cost of $7000.  The Commissioning Agent has submitted extra commissioning, measurement, and verification services related to the pipe break at an estimated cost of $3000.  The City Risk Manager will file a claim with the City's builder's risk insurance policy as the Contractor, Architect/Engineer, and Commissioning Agent submit invoices for work related to the pipe break.  The total amount will be reimbursed by the City's builder's risk insurance proceeds minus the deductible of $25,000.  It is City Engineering's intention to require the Contractor to cover the deductible cost.   
 
NOW, THEREFORE BE IT RESOLVED, that the 2013 Library Capital Budget (Fund No. CB18-810611) be amended to increase the budget authority in the Central Library project by $175,000, funded by a transfer of insurance proceeds from the Insurance Fund; and
 
BE IT FURTHER RESOLVED, that the Finance Director is hereby authorized to encumber an additional $165,000 to contract #6437 for construction contingency to cover the construction costs related to the pipe break, and
 
BE IT FURTHER RESOLVED, that the Mayor and the City Clerk are hereby authorized to execute an amendment to Contract #6436 between the City of Madison and Meyer Scherer & Rockcastle, Ltd. to authorize the extra work as described above and payment in the amount not to exceed $7000, and
 
BE IT FINALLY RESOLVED, that the Mayor and the City Clerk are hereby authorized to execute an amendment Contract # 6566 between the City of Madison and Sustainable Engineering Group, LLC to authorize the extra work as described above, in an amount not to exceed $3,000.
