Authorizing Arts Administrator to Sign Licensing Agreements Related to Public Art Collection
Body
WHEREAS, the City of Madison maintains a collection of public art, funds artistic activities and initiates cultural programs that integrate, support, and advance arts and culture as an essential part of life in Madison; and
 
WHEREAS, the City of Madison is the holder of the copyright to photographs and other images of its public art; and
 
WHEREAS, from time to time the City may wish to license others to use such photographs or images to advance public awareness of the arts and for educational purposes; and
 
WHEREAS, a current example would be the use by a computer programmer developing an application, for mobile devices, which will contain an inventory of public art and show the location of the art.
 
NOW THEREFORE BE IT RESOLVED, that the Arts Program Administrator is authorized to enter into licensing agreements, in a form approved by the City Attorney, that will permit the use of city owned photographs and images for educational and cultural purposes, and for advancing public arts and culture. Such licensing agreements shall require that the City of Madison retains the copyright to the photographs and images, that the photographs and images be credited to the City of Madison, that the photographs and images shall not be used in a downloadable format or in a manner that will be harmful to the City's interests or such other provisions as may be recommended by the City Attorney.
