These ordinance changes will clarify and update existing language in various areas.  In addition, several provisions can be expected to have modest impacts upon charges or rates.  Section 37.05(7)(a)2 creates a Stormwater System Connection Permit (replacing the existing Permit to Connect) and adds a permit surcharge fee for excessive discharges.   Fiscal impact is expected to be minimal.  Section 37.05(7)(a)3 creates a Stormwater System Disconnection or Abandonment Permit  with a fee of $1,000 of which up to $900 is refundable following an approved inspection.  The remainder of the fee covers the City's cost of proper disconnection.  Erosion Control, Stormwater Management and Non-Metallic Mines and Industrial Sites permit application fees have been updated to be consistent with Dane County rates.  The effect on the Utility's revenue and costs structure will vary annually as the cost to staff this program is largely fixed while the enforcement and review varies by number and type of permit being applied for.  It is expected that this change will generate additional revenue but not be of a significant enough change to affect an applicant's decision to apply or to provide sufficient funds to reduce significantly the subsidy the general rate payers provide for this service.  
 
Section 37.05(4)(f) establishes a new procedure for setting Stormwater Utility rates.  Under the new provisions, rates will be set annually by the City Engineer and approved by the Board of Public Works and the Common Council.  With this change, it will no longer be necessary to annually update Chapter 37 to include new rate changes.  No appropriation is required to support any of the proposed changes, nor is any impact upon the tax levy anticipated.

DRAFTER'S ANALYSIS:  This ordinance makes numerous changes to Chapter 37, MGO, to address changes in State regulations and update City stormwater and erosion control related procedures and requirements.  A full summary of the changes made to this Chapter are set forth in the Office of the City Attorney's memo attached to this file.

Chapter 37, entitled "The Public Stormwater System Including Erosion Control" of the Madison General Ordinances is hereby repealed and recreated to read as follows:
