Body
In February, 2011 Black and Veatch Inc. provided Madison Water Utility staff a report recommending that Unit Well 7 located on Sherman Avenue be reconstructed to bring it up to current Utility standards. This reconstruction would include the addition of an iron and manganese filter, the provision for the future addition of VOC treatment, and the increase in the reservoir size to 400,000 gallons to meet current standards. Well 7 is a key water supply, transmission and distribution component of the Madison drinking water system. The well provides drinking water and fire protection to upwards of 10,000 residents on the east and north sides of Madison. The proposed reservoir is sized to provide the long term emergency supply needs and fire fighting requirements of the system and is in line with Utility criteria, standard engineering practice and Insurance Service Office guidelines. The Utility is working closely with the Alder and citizen's groups in the neighborhood and has evaluated the setback requirements, screening needs, and facility footprint as they apply to the current planning and zoning criteria for the area. This evaluation indicated the need for additional property to construct the water transmission and distribution system associated with Well 7.
 
NOW COMES the City of Madison, Dane County, Wisconsin, by its City Council and for its Relocation Order hereby resolves as follows:
 
1.      That this Resolution is a Relocation Order in accordance with Sections 32.05(1) and 62.22, Wisconsin Statutes, for the purpose of the within described public acquisition project, and it is also a determination of necessity for that project in accordance with Section 32.07(2), Wisconsin Statutes.
 
2.      That the City of Madison Water Utility requires the expansion of its well transmission and distribution facility at Well No. 7 located at 1613 N. Sherman Avenue.
 
3.      That the City of Madison hereby determines that it is necessary and a public purpose to acquire fee simple interest in two parcels of land located at 1721 N. Sherman Avenue and 1713 Schlimgen Avenue, City of Madison, Dane County, for the construction and operation of said well transmission and distribution facility.
 
4.      That the fee simple interest to be acquired is shown on the Relocation Order Plat and Schedule of Interests Required, dated October 1, 2012, and entitled "Plat of Land Interests Required for an Expanded Well No. 7 Distribution and Transmission Facility", and that said Plat is attached to this Relocation Order as Exhibit A.
 
5.      That the Office of Real Estate Service of the Economic Development Division and the City Attorney are hereby authorized to proceed by negotiation or condemnation under the authority of Section 32 and 62.22 of the Wisconsin State Statutes to acquire the real estate interest identified and shown on said Relocation Order, and that the Real Estate Services is further authorized to obtain title reports, appraisals, survey information, environmental site assessment reports, and any other essential material or reports as may be necessary to perform due diligence in accomplishing the acquisition. That the staff of the Madison Water Utility and Engineering Department are authorized to proceed under Madison General Ordinances to proceed with the demolition of 1721 N. Sherman Avenue and 1713 Schlimgen Avenue upon acquisition of these properties.
 
6.      That the Director of the Economic Development Division is hereby authorized to execute the jurisdictional offer, lis pendens, and award of compensation if condemnation proceedings under Section 32 of the Wisconsin Statutes are necessary, and that the Mayor and City Clerk are authorized to sign any other necessary documents that may be necessary to accomplish the acquisition.
 
7.      That the Common Council of the City of Madison authorizes the acceptance of the documents conveying the necessary rights if obtained through negotiation or dedication.
 
8.      That the Mayor and City Clerk are hereby authorized to sign all necessary documents necessary to  accomplish the land interest acquisitions, relocation of owners and occupants and for demolition of the property acquired.
 
9.      That all required funding incurred by the City of Madison for staff costs, the acquisition and related expenses is available in Madison Water Utility Account No.EW01-58201-810517.
