Title
Authorizing the execution of a deed amendment restricting the use of 0.68 acres of land across a portion of Esther Beach Park, located at 2726 Waunona Way.
Body
WHEREAS, The City of Madison ("City") acquired two vacant lots containing 0.68 acres, located along Waunona Way, for expansion of Esther Beach Park, in December of 2010; and
WHEREAS, subsequent to the acquisition of said lots, the City Parks Division applied for and was granted funding by way of a Knowles-Nelson Stewardship and Development of Local Parks Outdoor Recreation Aids Grant Agreement ("Agreement"), from the State of Wisconsin Department of Natural Resources ("WisDNR"), to offset the acquisition costs for the 0.68 acres of land purchased for the Esther Beach Park expansion ("Property"); and
WHEREAS, as a condition of the Agreement, the City must execute a deed amendment restricting the Property from any use that is inconsistent with public outdoor recreation and the State of Wisconsin Stewardship Program and Agreement: and
WHEREAS, City of Madison Parks Division and Office of Real Estate Services staff has reviewed and approve of the deed amendment restricting the Property.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and the City Clerk are hereby authorized to execute a Deed Amendment restricting any use, of the 0.68 acres of land purchased for the Esther Beach Park expansion, that is inconsistent with public outdoor recreation and the State of Wisconsin Stewardship Program and Agreement; said land is legally described as follows:
Lots 1 and 2, Certified Survey Map No. 11988, as recorded in the Dane County Register of Deeds in Vol 73 Page 340 of Certified Surveys, as Document No. 4254407, City of Madison, Dane County, Wisconsin.
