Title
To SUSPEND the handcrafted goods, personally prepared food vending restrictions and INVALIDATE Mall/Concourse vending licenses from 6:00p.m. October 27 to 3:00a.m. October 28, 2012 in the areas specified in the Street Use Permit Frank Productions, Inc. will obtain for Freakfest 2012.
Body
WHEREAS, Section 9.13(6) of the Madison General Ordinances and the regulations adopted therein control street vending on the State Street Mall/Capitol Concourse area; and
WHEREAS, Section 9.13 (6)(k)1. allows the Common Council to suspend specifically enumerated vending ordinances or regulations and establish alternate rules and procedures during a special event; and
WHEREAS, Section 9.13(6)(k)3. authorizes the Common Council to invalidate street vending licenses, Mall-Concourse Vending Licenses and sidewalk cafe licenses within the perimeter of a special event in order to encourage the integrity, comprehensiveness and success of a special event; and
WHEREAS, FREAKFEST 2012 is such a special event; and
WHEREAS, Frank Productions, Inc., as organizer of the event, will obtain a Street Use Permit for the setup and conduct of this event from 6:00p.m. October 27 to 3:00a.m. October 28, 2012 and agrees to comply with the conditions of the permit, including but not limited to any conditions placed on the permit by the Street Use Staff Commission; and
WHEREAS, Frank Productions, Inc. wishes to insure the integrity, comprehensiveness and success of Freakfest 2012 by retaining control over the vending of both goods and food, and has demonstrated that special conditions exist which warrant such action by the Council; and
WHEREAS, Frank Productions, Inc. agrees to comply with all recommendations of the Street Use Staff Commission and the Vending Coordinator concerning the location of vending sites and use of electricity; and
