Title
Authorizing the Mayor and City Clerk to execute a Road Repair Reimbursement Agreement with American Transmission Company LLC for the construction of the Rockdale - West Middleton Transmission Project. (Various ADs)
Body
WHEREAS, American Transmission Company LLC (hereinafter "ATCLLC"), is constructing the Rockdale - West Middleton Transmission Line (hereinafter, the "Project") commencing in 2011, which will construct an electric transmission line within the City of Madison, and,
WHEREAS, as a result of the Project, ATCLLC's contractors, subcontractors, suppliers and material men (collectively "Contractors") will use roads, bridges, culverts and other City owned infrastructure over which the City has jurisdiction and authority, and,
WHEREAS, the City shall require an agreement, insurance and or bond to ensure that the work performed by the Contractors shall be repaired if any City owned infrastructure is damaged during the construction of the Project, and,
WHEREAS, ATCLLC shall pay the City a permit fee in the amount of Five Thousand and no/100 Dollars ($5,000) payable upon the execution of the Agreement, pursuant to Wis. Stats. Section 348.25(8)(f) for a permit for operating vehicles with a gross vehicle weight of 80,000lbs or less and shall pay an additional fee of five hundred dollars ($500) for each load exceeding 80,000 lbs (gross vehicle weight).
NOW, THEREFORE, BE IT RESOLVED, that the Mayor and City Clerk are authorized to execute a Road Repair Reimbursement Agreement with American Transmission Company LLC for the construction of the Rockdale - West Middleton Transmission Project.
