Title
To SUSPEND the handcrafted goods, personally prepared food vending restrictions and INVALIDATE certain Mall/Concourse vending licenses from 6:00p.m. July 8 to 9:00p.m. July 10, 2011 on the 200 block of Martin Luther King, Jr. Blvd. for the benefit of WI Alliance of Artists & Craftspeople, so that ART FAIR OFF THE SQUARE may occur.
Body
WHEREAS, Section 9.13 (6) of the Madison General Ordinances and the regulations adopted therein control street vending on the State Street Mall/Capitol Concourse area; and
WHEREAS, Section 9.13 (6)(k)1. allows the Common Council to suspend specifically enumerated vending ordinances or regulations and establish alternate rules and procedures during a special event; and
WHEREAS, Section 9.13(6)(k)3. authorizes the Common Council to invalidate street vending licenses, Mall-Concourse Vending Licenses and sidewalk cafe licenses within the perimeter of a special event in order to encourage the integrity, comprehensiveness and success of a special event; and
WHEREAS, the ART FAIR OFF THE SQUARE is such a special event; and
WHEREAS, WI Alliance of Artists & Craftspeople, as sponsor of the special event, agrees to obtain a Street Use Permit for the setup and conduct of this event from 6:00p.m. July 8 to 9:00p.m. July 10, 2011 and agrees to comply with the conditions of the permit, including but not limited to any conditions placed on the permit by the Street Use Staff Commission; and
WHEREAS, WI Alliance of Artists & Craftspeople, wishes to insure the integrity, comprehensiveness and success of ART FAIR OFF THE SQUARE by retaining control over the vending of both goods and food, and has demonstrated that special conditions exist which warrant such action by the Common Council; and
WHEREAS, the sponsors agree to comply with all recommendations of the Street Use Staff Commission and the Vending Coordinator concerning the location of vending sites and use of electricity; and
