Authorizing the Mayor and City Clerk to execute a temporary limited easement for sloping and grading purposes to the Town of Middleton for the reconstruction of a portion of Old Sauk Road.
Body
WHEREAS, the Town of Middleton (the "Town") will be reconstructing a portion of Old Sauk Road pursuant to the Old Sauk Road Improvements 2011 Project (the "Project"), approved by the Town Board on January 24, 2011; and
 
WHEREAS, the Town has requested a temporary limited easement for sloping and grading purposes ("TLE") across a portion of the City-owned property located at Old Sauk Road and Pioneer Road, which property is reserved as the future Blackhawk Water Tower site; and
 
WHEREAS, the TLE will benefit the City's property as it will allow for the blending of the slope adjacent to the reconstructed Old Sauk Road; and
 
WHEREAS, the Water Utility approves of the grant of the TLE to the Town of Middleton, at no cost to the Town of Middleton.
 
NOW, THEREFORE, BE IT RESOLVED that the Mayor and City Clerk are hereby authorized to execute a temporary limited easement for sloping and grading purposes to the Town of Middleton, pertaining to property owned by the City of Madison described below and depicted on attached Exhibit A (the "TLE Area"):
 
TLE Area:
The North 55 feet of the West 183 feet of the NW ¼ of the NE ¼ of Section 20, T7N, R8E, in the Town of Middleton, Dane County, Wisconsin, EXCEPTING THEREFROM the West 33 feet and the North 33 feet thereof.  Said excepted lands being within the public rights-of-way of Old Sauk Road and Pioneer Road.
