Approving Addendum No. 1 to the Subdivision Contract for Eighth Addition to Blackhawk, Phase 4, Contract No. 2202. (9th AD)
Body
WHEREAS, on August 8, 20 08, the developer, McKenzie 300 Corporation, had entered into a Subdivision Contract No. 2202 with the City of Madison and,
WHEREAS, Upon the Developer's request, Lots 482, 483, and 484 were omitted from the contract, and;
WHEREAS, the Developer has constructed public improvements adjacent to Lots 482, 483, and 484 as part of the original Contract, in accordance with Section 16.23(9) of the Madison General Ordinances, and;
WHEREAS, the Developer has now requested that Lots 482, 483, and 484 be included in Contract No. 2202.
NOW, THEREFORE, BE IT RESOLVED, that the Mayor and City Clerk are hereby authorized and directed to execute Addendum No. 1 for Eighth Addition to Blackhawk, Phase 4, with McKenzie 300 Corporation to include Lots 482, 483, and 484 and execute a Release of the Declarations of Conditions, Covenants, and Restrictions on the lots for which the public improvements are provided.
