Approving a maintenance agreement for privately maintained improvements within the public right of way (S. Midvale Boulevard Right of Way adjacent to 555 S. Midvale Boulevard). (11th AD)
Body
WHEREAS, the property owner, Midvale Plaza Joint Venture, LLP, has requested to make specific improvements within the terrace S. Midvale Boulevard Right of Way adjacent to 555 S. Midvale Boulevard, in conjunction with the infrastructure improvements and upgrades to their site, and;
WHEREAS, Midvale Plaza Joint Venture, LLP has received approval for a Minor Alteration to a PUD(SIP) for the installation of the site improvements, and;
WHEREAS, prior to authorizing Midvale Plaza Joint Venture, LLP to make improvements to the S. Midvale Boulevard right of way, the City is requiring execution of a maintenance agreement for said improvements of way to insure the public's long term use and functions.
NOW, THEREFORE, BE IT RESOLVED:
1. That the Mayor and City Clerk are hereby authorized and directed to execute an agreement between The City of Madison and Midvale Plaza Joint Venture, LLP for the Maintenance of portions of the public right of way at 555 S. Midvale Boulevard.
