Amending Sections 23.05(3)(a), 23.05(1), and 23.05(4)(e) of the Madison General Ordinances to prohibit smoking in all areas of City parking garages.

DRAFTER'S ANALYSIS: This ordinance prohibits smoking in all areas of City parking garages including elevators and stairwells.

The Common Council of the City of Madison do hereby ordain as follows:
1. Subdivision (a) of Subsection (3) entitled “Prohibition of Smoking in Public Places” of Section 23.05 entitled “Smoking Prohibited in Certain Areas” of the Madison General Ordinances is amended to read as follows:
“(a) In all areas of City parking garages, including but not limited to Eelevators and stairwells of City parking ramps.”
2. Subdivision entitled “Entrance” of Subsection (1) entitled “Definitions” of Section 23.05 entitled “Smoking Prohibited in Certain Areas” of the Madison General Ordinances is amended to read as follows:
““Entrance” means a doorway, access area for vehicles and adjacent area which gives direct access to a building or City parking ramps garages from a contiguous street, plaza, sidewalk or parking lot.”
3. Subdivision (e) of Subsection (4) entitled “Prohibition of Smoking in Outdoor Areas” of Section 23.05 entitled “Smoking Prohibited in Certain Areas” of the Madison General Ordinances is amended to read as follows:
“(e) Within ten five (105) feet of all entrances to City parking rampsgarages.”
4. The City Attorney is directed to make corresponding changes to other City ordinances to reflect this updated reference in Chapter 23.
