Fiscal Note

The proposed ordinance change reflects a guardian’s responsibility to insure there is not an unlawful use of the emergency telephone number (911). The fiscal impact, if any, is anticipated to be very minimal.

Amending Section 24.01 of the Madison General Ordinances to reflect a guardian’s responsibility to insure there is not an unlawful use of the emergency telephone number.

DRAFTER'S ANALYSIS:  This ordinance holds a guardian or other adult who has the care, control or custody of an individual responsible if said individual intentionally dials the emergency telephone number 911 to report an emergency knowing that the fact situation reported does not exist and the guardian permits said violation.

The Common Council of the City of Madison do hereby ordain as follows:

 

                     Section 24.01 entitled “Unlawful Use of Emergency Telephone Number” of the Madison General Ordinances is amended to read as follows:

 

24.01                     UNLAWFUL USE OF EMERGENCY TELEPHONE NUMBER.

(1)                     It shall be unlawful to intentionally dial the emergency telephone number “911” to report an emergency to city departments knowing that the fact situation reported does not exist.

(2)                     No parent, guardian or other adult person having the care and or custody of a child an individual shall suffer or permit or by inefficient control all such child said individual to violate subsection (1).

                     (3)                     Any person who violates any provision of this section shall be subject of a penalty not more than one thousand dollars ($1000).”
