The proposed resolution amends RES-23-00694 (Legistar #80369) adopted November 7, 2023 and approves amended plans and specifications for public works improvements necessary for the project known as Western Addition to 1000 Oaks Park Improvements. The resolution revises the scope of the work the Developer is undertaking on the project. Based on the revised plans, the maximum Deferred Park Infrastructure Impact Fee credit available to the Developer will be reduced by $7,615.15 to $101,070 (previously $108,586.15). Funding for this project is available in the 2024 Parks Division's 2024 Adopted Capital Budget (Munis #17421). No additional appropriation is required.

WHEREAS, RES-23-00694 (Legistar File No. 80369) was adopted on Nov. 7, 2023. This resolution approved plans and specifications for public improvements necessary for the project known as Western Addition to 1000 Oaks Park Improvements, and authorized construction to be undertaken by the Developer, VHET, LLC, through Private Contract No. 9388; and,
WHEREAS, the Developer has indicated that the correct entity for the work will be VH Birchwood South, LLC; and,
WHEREAS, the Developer and the Parks Division have agreed to revise the approved plans and specifications for the project, specifically to revise the grading plan and remove native planting establishment from the development agreement due to increased cost estimates of the project.
NOW, THEREFORE, BE IT RESOLVED, that RES-23-00694 is hereby amended to change the Developer’s name from VHET, LLC to VH Birchwood South, LLC.
